Safety Directors Webinar Series with Gary Auman

Gary Auman is the president of the law firm of Auman Mahan & Furry. He has the reputation of being a thoughtful management advocate before OSHA and has worked with OSHA at all levels regarding several issues including possible standards for fiberglass exposure and for the use of treated wood. He represents and advises employers before state and federal OSHA on compliance issues as well as defending them before OSHA in federal and state-plan OSHA states.

Instance by Instance Inspections by OSHA

In this session members will be educated on the new enforcement guidance aimed at making penalties more effective in stopping employers from repeatedly exposing workers to life-threatening hazards or failing to comply with certain workplace safety and health requirements. The guidance, which became effective March 27, 2023, replaces the current policy which has been in place since 1990 and only applied to egregious willful citations.

Gary will also be giving an update on the National Emphasis Program (NEP):

  1. OSHA issued a National Emphasis Program (NEP) on fall protection that went into effect on May 1st. it is to be enforced beginning on August 1st.

  2. The NEP provides probable cause for any OSHA compliance officer to stop and inspect any worksite on which he/she observes any employee working more than six feet above to ground or level below them.

  3. As they inspect fall protection they will be able to cite employers for any other safety violations and inspect training records, etc.

  4. I will also cover some OSHA fall protection standards many employers miss entirely of fail to understand completely. Some of these standards are found at 29 CFR 1926. 501(a)(2) and 1926.503(a).
