Insurance Coverage and the Dangers of Subcontracting Labor

February 7, 2024 @ 7:45 am - 9:15 am PST

Whitfield & Eddy Law - Justin Sullivan

Learning Objective: Understand the legal risks and distinctions between insurance coverage and legal liability when assessing the financial gains of contracting labor.

As subcontracted labor becomes more and more common in both residential and commercial construction, contractors should know what legal and financial risk is at stake.

This presentation will discuss the topics of subcontracted labor in both residential and commercial roofing.  Specifically, it will cover the differing insurance coverage types available for injuries and workmanship, i.e. workers compensation insurance, errors and omissions, and commercial general liability.  Contractors will learn the differences of opinions when it comes to classifying a worker as an employee or independent contractors for triggering of insurance coverage.

Insurance coverage and exclusions will be examined as well as the best practices for legal liability and insurance coverage at all tiers.  This presentation will also touch on documentation of workers and immigration issues involved.
